Warranty & Terms offered by SMGHE

• Limited Warranty offered by SMG Heavy Equipment for various components, parts, and manufacturers.
• Detailed warranty information, including length and conditions, available on the invoice or through account representative.
• Warranty Period: Goods will materially conform to buyer’s specifications and be free from material defects during this period.
• No other warranties provided by SMG Heavy Equipment, including warranties of merchantability, fitness for a particular purpose, title, or infringement of intellectual property rights.
• Third Party Products are not covered by the warranty.
• Buyer must notify SMG Heavy Equipment in writing within 15 days of discovering a defect and request an RMA or RGA.
• Buyer to return Goods to SMG Heavy Equipment’s place of business for examination, with shipping costs covered by SMG Heavy Equipment (except for buyers outside the UAE).
• SMG Heavy Equipment is not liable if the buyer continues to use the Goods after giving notice, fails to follow instructions, alters or repairs the Goods without consent, or opens the part for inspection without following instructions.
• Remedies during the Warranty Period: SMG Heavy Equipment may repair, replace, credit, or refund the price of the Goods, at its sole discretion.
• Remedies provided in the warranty are the buyer’s sole and exclusive remedy for any breach.
• SMG Heavy Equipment is not liable for any consequential, indirect, incidental, special, exemplary, or punitive damages.
• SMG Heavy Equipment’s aggregate liability does not exceed the total amount paid for the Goods.
• Restocking fees may apply for non-defective or incorrectly ordered products, ranging from 15% to 25% based on the product. Refunds may not be available for rebuilds and special orders.
• International shipping claims: Freight costs for international shipping are not compensated by SMG Heavy Equipment, regardless of warranty outcome or incorrect orders.
• This warranty does not include materials or labor not provided by SMG Heavy Equipment, unless approved in writing by the sales representative. Remedies are limited to the sales price of the parts.
• SMG Heavy Equipment is not responsible for damages to other parts or equipment, downtime or rental on replacement machines, or other claims for damages.
• Notification to SMG Heavy Equipment and return of Goods must be made within the warranty period.
• This warranty replaces all other expressed or implied warranties, including warranties of merchantability or fitness as described by the Uniform Commercial Code.
• Restocking fees may apply for non-defective or incorrectly ordered products, ranging from 15% to 25% based on the product. For more information, consult a sales associate.
